The Secretary General of the Indonesian Solidarity Party (PSI), Raja Juli Antoni, has reignited the national discourse surrounding the parliamentary threshold, urging policymakers to formulate a more equitable system to ensure that the voices of millions of voters are not discarded in future general elections. Speaking from the Presidential Palace in Jakarta on Thursday, September 24, Antoni emphasized that the existing mechanism, which excludes parties failing to meet a minimum percentage of the national vote from the House of Representatives (DPR), results in a significant "wasted vote" phenomenon that undermines democratic representation.
This call for reform follows a landmark Constitutional Court (MK) ruling, which highlighted the necessity for legislators to reconsider the current threshold structure. Antoni’s comments underscore a growing movement among political analysts and civil society organizations who argue that the four percent threshold—a fixture of the 2024 legislative elections—disproportionately disenfranchises voters and artificially limits the plurality of the Indonesian parliament.
The Context of the Parliamentary Threshold
The parliamentary threshold is a legal instrument designed to simplify the political landscape by limiting the number of parties in the legislature. Historically, Indonesia has incrementally increased this threshold over the last two decades. In 2009, the threshold was set at 2.5 percent, which was then raised to 3.5 percent in 2014, and subsequently increased to 4 percent in 2019 and 2024.
Proponents of the threshold argue that it promotes a "simple multi-party system," theoretically leading to a more stable government and more efficient legislative processes. However, critics, including the leadership of PSI, contend that the policy serves as a barrier to entry for smaller, ideological, or emerging parties, thereby cementing the dominance of established political dynasties and traditional party machines. The Constitutional Court’s recent focus on the "mubazir" or wasted nature of these votes has provided a legal impetus for a potential restructuring ahead of the 2029 electoral cycle.
Quantifying the Impact: The 2024 Election Data
The scale of the issue became apparent following the 2024 legislative elections. According to data from the General Elections Commission (KPU), the four percent threshold resulted in approximately 16 million votes being effectively discarded. Because the parties that received these votes failed to meet the minimum requirement to enter the DPR, those millions of individual ballots did not translate into legislative seats.
This phenomenon creates a disconnect between the electorate’s intent and the resulting composition of the parliament. When millions of voters support a party that ultimately gains zero seats, the political legitimacy of the winning parties—and the parliament as a whole—can be questioned. Analysts point out that in a healthy democracy, the weight of a vote should ideally be consistent regardless of whether the chosen party successfully passes a pre-determined arbitrary hurdle.
Chronology of the Legal Debate
The debate over the threshold is not new, but it has gained urgency following several key developments:
- 2009–2019: The threshold is gradually raised, meeting little resistance as the major parties consolidate their power.
- Early 2023: Several civil society groups file a judicial review with the Constitutional Court, challenging the constitutionality of the four percent threshold, citing its exclusionary nature.
- February 2024: The legislative elections take place, resulting in the exclusion of several parties that collectively accounted for millions of votes.
- Early 2024 (Post-Election): The Constitutional Court issues a ruling noting that while the threshold is within the constitutional authority of the legislature to set, the current model requires a re-evaluation to prevent the excessive loss of electoral representation.
- September 2024: Raja Juli Antoni calls for a reform, aligning PSI’s position with the court’s sentiment that the current formula is outdated and unjust.
Official Responses and Political Strategy
While Raja Juli Antoni is pushing for a fairer system, he maintains that PSI is prepared to compete under any conditions established by the DPR. Despite being a non-parliamentary party, PSI has positioned itself as a resilient entity capable of mobilizing significant resources and support.
"PSI is ready to fight in 2029, regardless of the threshold set," Antoni stated. He attributed the party’s confidence to several factors, including the leadership of General Chairman Kaesang Pangarep and the significant moral and political endorsement from President Joko Widodo. The party is clearly positioning itself to leverage its recent electoral performance, despite falling short of the threshold, as a foundation for a stronger showing in the next five-year cycle.
From the perspective of established parties in the DPR, the stance on the threshold remains polarized. Larger parties, such as PDI-P and Golkar, have traditionally supported higher thresholds to maintain the status quo and prevent fragmentation. Conversely, smaller parties often advocate for a reduction of the threshold to three percent or even its complete removal, arguing that every vote cast should be represented proportionally.
Implications for Indonesian Democracy
The potential revision of the parliamentary threshold carries profound implications for the Indonesian political ecosystem. If the threshold is lowered or replaced by a more flexible seat-allocation formula, the DPR could see an influx of smaller parties, potentially making legislative consensus more difficult to achieve but significantly increasing the diversity of the house.
There is also a broader question regarding the "mubazir" nature of votes in a democracy. If the Constitutional Court continues to lean toward protecting the value of each vote, the legislature may be forced to consider alternative electoral methods, such as a more granular proportional representation system that does not rely on high national hurdles.
Furthermore, the focus on "wasted votes" is likely to dominate the legislative agenda in the coming months as the DPR begins drafting revisions for the 2029 electoral laws. Legal experts suggest that the government must balance the need for a simplified, functional parliament with the democratic imperative of ensuring that the majority of the population feels their participation is meaningful.
Analysis: The Path Forward
The argument put forth by Raja Juli Antoni highlights a critical intersection between law, strategy, and democratic ethics. While PSI’s political motivation is clear—the party seeks a lower barrier to enter the national legislature—the underlying issue is structural. If a system continuously discards the votes of nearly 10 percent of the electorate, the democratic mandate of the parliament is diluted.
Moving forward, the Indonesian government faces three potential paths:
- Maintain the Status Quo: Keep the four percent threshold, potentially fueling public apathy and distrust in the electoral process.
- Incremental Adjustment: Lower the threshold to a figure like 2.5 or 3 percent, which may satisfy some smaller parties while maintaining some degree of legislative consolidation.
- Fundamental Reform: Adopt a proportional system that allows for smaller parties to gain seats without a strict national hurdle, effectively ending the "wasted vote" dilemma but risking a return to the fragmented parliaments of the late 1990s.
As the political class looks toward 2029, the rhetoric surrounding the parliamentary threshold will likely become a litmus test for the commitment of Indonesian leaders to a more inclusive, representative, and responsive democracy. The Constitutional Court’s intervention has opened the door for this debate; it remains to be seen whether the legislators in the DPR have the political will to prioritize voter representation over their own strategic interests.
For now, parties like PSI remain in a state of high alert, balancing the push for systemic change with the pragmatic necessity of preparing for a challenging electoral environment. The coming years will be decisive in determining whether the Indonesian electoral system evolves to better reflect the diverse political voice of its citizens or continues to rely on exclusionary mechanisms that prioritize administrative convenience over genuine democratic representation.
