The Constitutional Court of the Republic of Indonesia (Mahkamah Konstitusi or MK) is set to convene a critical evidentiary hearing regarding the 2024 Presidential and Vice-Presidential Election Dispute (PHPU) on Wednesday evening, September 30, 2026. This session, scheduled to begin at 19:00 WIB at the MKRI 1 Building in Jakarta, marks a pivotal moment in the legal challenge filed by a coalition of twelve petitioners, led by legal scholar and former Deputy Minister of Law and Human Rights, Denny Indrayana. The proceeding will focus on the submission of expert testimonies, witness statements, and the formal verification of supplemental evidence presented by the petitioners to substantiate their claims regarding the integrity of the 2024 electoral process.

Background and The Legal Challenge

The legal challenge, registered under case number 01/PHPU.PRES-XXIV/2026, was officially filed on September 10, 2026. The petitioning group consists of a diverse coalition of individuals, including Ansufri ID Sambo, Brahma Aryana, Tiurma M.S. Sihombing, Bonatua Silalahi, M. Subhan, Moeryono, Soenarko MD, Hanafie Asnan, Slamet Soebijanto, Tyasno Sudarto, Fachrul Razi, and Denny Indrayana.

At the core of the petitioners’ argument is a series of allegations concerning procedural irregularities and the legitimacy of candidate eligibility, which the group contends significantly undermined the democratic quality of the 2024 presidential election. One of the more contentious elements of their petition involves the academic credentials of key political figures, including Vice President-elect Gibran Rakabuming Raka. Denny Indrayana has publicly acknowledged his efforts to reach out to educational institutions in Singapore and Australia to verify the validity of these credentials, suggesting that the evidentiary phase will lean heavily on documentation regarding candidate qualifications and administrative compliance.

Chronology of Proceedings

The judicial review process at the Constitutional Court follows a strictly regulated timeline designed to address election disputes within the constitutional timeframe. The progression of this case has been rapid:

  • September 10, 2026: Formal filing of the petition by the twelve applicants at the Constitutional Court.
  • September 21, 2026: The inaugural session, focusing on Preliminary Examination. During this stage, the petitioners presented their case, outlining the core allegations and the specific legal provisions they believe were violated during the electoral period.
  • September 23, 2026: The second session, dedicated to hearing the Respondent’s answer (the General Elections Commission or KPU), statements from relevant parties (including the winning candidate’s legal team), and the official report from the Election Supervisory Body (Bawaslu).
  • September 30, 2026 (Tonight): The Evidentiary Hearing for the Petitioners. This phase allows the applicants to present their witnesses and expert testimonies to support their petition, as well as the formal validation of supplementary evidence.
  • October 1, 2026: The Evidentiary Hearing for the Respondent, Relevant Parties, and Bawaslu. This session will provide the opposing side an opportunity to counter the evidence presented by the petitioners and offer their own expert testimonies.

Expert Testimonies and Judicial Scrutiny

The session on September 30 is expected to be lengthy and intense. Under Indonesian election law, the role of the Constitutional Court in a PHPU is not merely to conduct a recount of votes, but to assess whether there were structural, systemic, and massive violations that could affect the final tally or the legitimacy of the outcome.

Legal observers note that the inclusion of figures like former high-ranking military officials and experienced legal scholars among the petitioners signals a concerted effort to shift the debate from minor administrative errors to broader constitutional questions. The Court is expected to scrutinize the testimony of experts in election law, public administration, and potentially information technology, as digital integrity remains a focal point of modern election disputes.

Perspectives from the Respondent and Relevant Parties

While the petitioners are focused on highlighting irregularities, the Respondent—the KPU—and the relevant parties involved in the election have maintained that the process was conducted in accordance with prevailing laws and regulations. The KPU is expected to argue that any discrepancies identified by the petitioners are either immaterial to the overall result or have been addressed through internal administrative channels.

Relevant parties, typically representing the victorious presidential ticket, have historically argued that such petitions are a standard part of the democratic process but are ultimately unfounded. They contend that the election was observed by both domestic and international monitors, and that the results reflect the will of the electorate as expressed through the ballot box. Bawaslu, as an oversight institution, serves as a crucial witness, providing the Court with an objective summary of the reports and violations they processed during the election period.

The Broader Implications of the 2026 Dispute

The resolution of this case holds significant implications for the future of Indonesian electoral law. As the Constitutional Court deliberates, the legal community is watching closely to see how the Court interprets the boundaries of "structural and systematic" violations. A ruling in favor of the petitioners could trigger a mandatory re-vote in specific districts or regions, while a rejection would solidify the current results and close the legal avenue for challenging the 2024 outcome.

Furthermore, the public discourse surrounding this case highlights the growing reliance on international verification, as seen in the petitioners’ outreach to foreign educational institutions. This adds a layer of complexity to the judicial review, requiring the Court to determine the relevance of cross-border documentation in a domestic constitutional dispute.

Analytical Perspective: The Burden of Proof

In the context of Indonesian election disputes, the burden of proof rests heavily on the petitioners. According to the Constitutional Court’s procedural rules, the petitioners must provide more than just circumstantial evidence; they must demonstrate a causal link between the alleged violations and the change in the final election results.

The Court’s decision to schedule consecutive nights of hearings—September 30 and October 1—indicates an urgency to conclude the evidentiary phase before moving to the deliberations (Rapat Permusyawaratan Hakim). This suggests that the justices are operating under a tight schedule to ensure that the final verdict is delivered within the statutory limits defined by the Law on the Constitutional Court.

Conclusion and Outlook

As the nation looks toward the Constitutional Court, the atmosphere in Jakarta remains focused on the judicial process. The hearings serve as a litmus test for the independence and efficacy of the judiciary in managing high-stakes political conflicts. Whether the evidence presented by Denny Indrayana and his fellow petitioners will be sufficient to sway the justices remains to be seen.

For now, the focus shifts to the MKRI 1 Building, where the testimonies heard tonight will form the bedrock of the Court’s final determination. The legal teams for both sides are prepared for a rigorous cross-examination, and the outcome of these proceedings will undoubtedly shape the political landscape of Indonesia for the coming years. Following the completion of the evidentiary phase on October 1, the public will await the final verdict, which will represent the ultimate interpretation of the law regarding the 2024 Presidential and Vice-Presidential Election.

As the Constitutional Court process reaches its crescendo, the importance of maintaining public order and respect for the judicial institution is paramount. The judiciary remains the final arbiter in this constitutional dispute, and its eventual ruling will provide the definitive closure required for the country to move forward from the 2024 electoral cycle.

Gugatan Ijazah Gibran di MK, Projo: Tak Satu Pun Argumen Pemohon Jawab Masalah Hukum Acara PVH

by Ali Ikhwan
written by Ali Ikhwan

The legal and political landscape in Indonesia faces a fresh wave of turbulence as the Constitutional Court (Mahkamah Konstitusi or MK) reviews a high-stakes General Election Result Dispute (PHPU) regarding the educational qualifications of Vice President Gibran Rakabuming Raka. Filed by prominent legal scholar and constitutional expert Denny Indrayana alongside a coalition of petitioners, the lawsuit has triggered sharp responses from various political factions. Among the most vocal respondents is Projo (Pro Jokowi), a major political volunteer organization that propelled the previous administration and continues to support the current government. Projo has formally urged the Constitutional Court to weigh the profound constitutional and systemic fallout that could accompany any ruling altering the outcome of the 2024 presidential election long after the democratic process has formally concluded.

The core of the legal contestation centers on allegations concerning Gibran Rakabuming Raka’s educational credentials and what the petitioners describe as procedural manipulations or constitutional smuggling in how candidacy requirements were validated. However, Projo’s leadership has pushed back aggressively, arguing that the petition fundamentally fails to address the rigorous tenets of procedural law governing election disputes. As the case deepens, it raises critical questions about the finality of democratic verdicts, the stability of the executive branch under President Prabowo Subianto and Vice President Gibran Rakabuming Raka, and the broader boundaries of constitutional adjudication in the world’s third-largest democracy.

Background Context and Chronology of the 2024 Presidential Election Dispute

To fully understand the gravity of the current proceedings at the Constitutional Court, it is essential to trace the chronology that brought Indonesia to this juncture. The 20th presidential election cycle in Indonesia, held on February 14, 2024, witnessed a historic victory for the Prabowo Subianto-Gibran Rakabuming Raka ticket, which secured a decisive majority in the first round with over 58% of the national vote. The pair was subsequently inaugurated on October 20, 2024, marking the formal transition of power from outgoing President Joko Widodo.

However, the path to the inauguration was fraught with intense legal and political friction. Months before the election, specifically in October 2023, the Constitutional Court issued a controversial ruling—Decision Number 90/PUU-XXI/2023—which modified the age requirements for presidential and vice-presidential candidates. This decision created an exception for individuals who had been elected to regional posts, thereby clearing the legal path for Gibran, then the Mayor of Solo, to run alongside Prabowo.

Despite subsequent ethics investigations involving the judiciary and widespread public debate, the General Elections Commission (KPU) officially certified the election results, and initial post-election challenges filed by rival camps in early 2024 were ultimately dismissed by the Constitutional Court. Yet, the legal battles did not cease. In late 2025 and stretching into 2026, new petitions spearheaded by Denny Indrayana emerged, pivoting heavily on claims regarding educational documentation, administrative compliance, and alleged systemic irregularities in the processing of the vice-presidential candidacy—culminating in the current PHPU hearings currently managed by the bench.

Projo’s Stance: Warnings of Constitutional Crisis and Legitimacy Deficits

During a press briefing held in Jakarta on Friday, September 25, 2026, Projo Secretary-General Freddy Damanik laid out the organization’s stern apprehensions regarding the ongoing litigation. Damanik asserted that the legal arguments presented by Denny Indrayana and his co-petitioners completely bypassed the fundamental requirements of administrative and procedural law governing election results disputes (Perselisihan Hasil Pemilihan Umum).

"Not a single argument put forward by the petitioners answers the core problems of the procedural law framework," Damanik stated during the conference. He emphasized that the petition attempts to reopen a closed political chapter by weaponizing judicial avenues to challenge an executive branch that has already assumed office and is actively governing.

Projo’s primary thesis rests on the doctrine of constitutional stability and institutional finality. Damanik warned the Constitutional Court that any legal interpretation or verdict perceived as retroactively invalidating or fundamentally altering the results of a concluded national election poses a severe institutional hazard. According to Projo, such a ruling could trigger a cascading crisis of public confidence, deepen societal polarization, and cast a debilitating shadow over the legitimacy of the administration led by President Prabowo Subianto and Vice President Gibran Rakabuming Raka.

"When a constitutional court decision is perceived as a fundamental disruption to election outcomes after the entire political process has been finalized, the logical consequences include a crisis of confidence, political polarization, and turbulence surrounding governmental legitimacy. This must be given serious consideration from a constitutional perspective," Damanik added.

The Legal Battlegrounds: Ijazah Claims vs. Procedural Limitations

The legal arguments brought forward by Denny Indrayana encompass a dual-layer strategy. On one hand, the petitioners have targeted the validity and transparency of Gibran’s academic credentials—commonly referred to in Indonesian public discourse as the ijazah controversy. They contend that discrepancies in educational background documents violate the strict statutory prerequisites stipulated in the Election Law. On the other hand, the petitioners frame the dispute around the broader concept of constitutional smuggling (penyelundupan hukum), arguing that systemic flaws during the registration and verification phases compromised the integrity of the electoral process from its inception.

Legal analysts observing the hearings note that the petitioners face an exceptionally high legal threshold. Under Indonesia’s election law framework, PHPU petitions before the Constitutional Court are traditionally constrained by strict deadlines and must demonstrate a direct, quantifiable impact on the vote count that would alter the electoral outcome. By shifting the focus to qualitative eligibility criteria and administrative compliance post-inauguration, the petitioners are pushing the boundaries of what the Constitutional Court has historically been willing to adjudicate outside the immediate post-voting window.

Conversely, defense attorneys and supporting legal teams representing the government and the KPU maintain that the judicial window for challenging candidate eligibility closed well before election day and certainly prior to the official inauguration. They argue that entertaining retroactive disqualification claims sets a dangerous precedent that could destabilize any future democratic transition in Indonesia, rendering every elected official perpetually vulnerable to post-hoc judicial challenges.

Broader Implications for Indonesian Democracy and Governance

The implications of the ongoing litigation extend far beyond the immediate fate of Vice President Gibran Rakabuming Raka. As the Constitutional Court deliberates on the merits and admissibility of the petition, several key institutional themes are under intense scrutiny:

  1. The Finality of Electoral Verdicts: A core pillar of democratic stability is the principle of legal certainty (rechtszekering). If election results can be unraveled months or years after an administration takes office based on challenges to candidate prerequisites, the predictability of democratic transitions in Indonesia could be severely undermined.

  2. The Role of the Constitutional Court: The case places immense pressure on the bench of the Constitutional Court to balance rigorous adherence to constitutional rights with the practical realities of state stability. The court must navigate the delicate line between acting as a guardian of the constitution and avoiding entanglement in prolonged political disputes that threaten to politicize the judiciary further.

  3. Executive Stability and Policy Continuity: For the administration of President Prabowo Subianto, administrative distractions and legal controversies surrounding the vice presidency threaten to consume political capital. While the coalition supporting the government holds a dominant majority in the House of Representatives (DPR), legal challenges to the legitimacy of the executive branch inevitably influence investor confidence, public sentiment, and the smooth execution of national development agendas.

Outlook and Next Steps in the Constitutional Court

As the hearings progress through late September 2026, all eyes remain fixed on the Constitutional Court building in central Jakarta. The bench is expected to evaluate both the procedural standing of the petitioners and the substantive arguments regarding administrative law.

While organizations like Projo continue to lobby public opinion and caution against the specter of institutional instability, the legal teams representing the petitioners remain steadfast in their pursuit of judicial accountability. Regardless of the final verdict, this landmark legal battle will undoubtedly leave an indelible mark on Indonesian constitutional jurisprudence, redefining the legal parameters under which election outcomes and executive legitimacy can be contested in the world’s third-largest democracy.
